Suchitra Ragupathy is a partner in our Litigation and Dispute Resolution practice group and Co-Head of the Family/Matrimonial practice. Suchitra is an active trial lawyer with 32 years of experience in the courts. Since 1993, she has made numerous appearances before the High Court and the Court of Appeal as lead. She has successfully represented many clients in contentious court proceedings.

Her area of practice is matrimonial law and contentious trust and probate matters. She has handled high-profile divorces and custody cases, some of which are high-publicity-risk matters, including cases involving foreign marriages and division of matrimonial assets which run into the tens of millions.

Suchitra's experience in divorce and family law also includes litigating and negotiating complex matters such as high-net-worth divorce, child custody, and cross-border issues.

Her experience includes the representation of accomplished people in the fields of law, finance, medicine, real estate, business, and public service. She also regularly represents their spouses.

Suchitra also represents clients in court litigation involving property and estates disputes. She has also handled estate and trust disputes including trustee resignation/removal, undue influence, breach of fiduciary duty and related claims, and accounting. Recent trial experience includes: Successfully acting for a client to intervene in, and defeat a claim in the Singapore High Court for $13 million that was based on sham agreements between the client’s ex-husband and his first ex-wife in Chiang Ai Ling v Tan Kian Chye and another [2024] SGHC 330. Successfully acting for  the client (the wife) in a High Court case on the division of matrimonial assets and garnering a 85% division in her favor  in WRZ v WSA [2023] SGHCF 51.

Before specializing in family law and estate matters, Suchitra had commercial litigation experience. Her experience in this area underpins her strategic approach in matters involving financial structures and valuation issues.

Suchitra has handled cases in the Family Court, High Court and Court of Appeal.

She is also a certified collaborative lawyer.

Experience

  • Chiang Ai Ling v Tan Kian Chye and another [2024] SGHC 330: Successfully acted for the client to intervene in, and defeat a claim in the Singapore High Court for $13 million, showing that the agreements between the client’s ex-husband and his first ex-wife were a sham. They had colluded to come up with the agreements to reduce the matrimonial pool of assets up for division in the divorce proceedings between the client and the ex-husband. 
  • WRZ v WSA [2023] SGHCF 51: Successfully acted for the client (the wife) in a High Court case on the division of matrimonial assets, obtaining 85% of the assets for the client by showing that the client was not only the breadwinner but managed most the responsibilities at home. 
  • UHA v UHB [2018] SGFC 63 and 23: Cross-border and relocation issues.   
  • In 2018, acted in cases involving third-party interests in marital assets. 
  • TBZ v TCH [2017] SGHCF 18: Asset division worth S$21 million, involving issues of legal and commercial complexity.
  • UHG v UHH [2017] SGFC 131: Whether the retrenchment benefits received during the marriage in respect of employment before marriage was up for division.
  • Koh Yen Ling v Tan Teik Yu Mark [2015] SGFC 126: Whether an asset held on resulting trust is up for division.
  • High-net-worth individual: In 2015, acted for the wife and successfully obtained an equal share in the business and the companies' assets. Successful in defending the appeal in the Court of Appeal. 
  • Surinder Singh s/o Jaswant Singh v Sita Jaswant Kaur [2014] 3SLR 1284: This was the first case where terms agreed at mediation were upheld – Court of Appeal decision.
  • Wong Kien Keong v Khoo Hoon Eng [2014] 1 SLR 134: The deed of separation was held to be binding, but in the distribution of the assets, the court included a share in the retirement benefits, which included the client origination credits even though it was not provided in the deed.  
  • TAE v TAF [2014] SGDC 47: Representing the father, who was only given supervised access at the first instance hearing. However, on appeal, the decision was overturned, and the father was given unsupervised access and overnight access. 
  • High-net-worth individual: In 2014, succeeded in upholding the distribution of assets as per the prenuptial agreement in a contested hearing on the division of assets. 
  • AFS v AFU [2011] SGHC 52: Succeeding in obtaining 25% of the stock options worth S$13 million for the wife, which the husband received after separation. Also, securing an injunction to avoid dissipation of assets. Successful in defending the appeal at the Court of Appeal. The case is also cited in leading textbooks as an excellent decision, i.e., for not upholding the Deed of Separation as the husband failed to give full and frank disclosure.
  • High-net-worth foreign individuals: Obtaining injunctions to prevent dissipation of assets and stay of divorce proceedings in respect of another forum.  
  • Confidential clients: arbitration with respect to custody and division of assets.  
  • High-net-worth individuals: Advising on financial settlements on divorce – options and ways to protect assets, pensions, retirement benefits, family business or inheritance.  
  • Various clients: Assisting third parties with respect to their assets/estate, involved and caught up in litigation.  
  • Various clients: Advising foreign nationals on divorce and issues of jurisdiction and domicile. 
  • Confidential clients: Advising on cross-border custody litigation.
  • High-net-worth individuals: Advising on financial agreements including prenuptial agreements, parenting matters, child support, divorce, spousal maintenance, and relocation matters. 
  • Confidential client: Contested application for a grant of probate. 
  • Various clients: Advising on claims and issues arising out of grants of probate, estate administration, and the executor’s duties & liabilities.
