The construction industry has been one of the most targeted industries by competition and anti-trust regulators worldwide due to the sheer number of violations uncovered. Numerous cartel arrangements, bid rigging, cover pricing and market sharing have been exposed and charged with fines reaching record levels.

In April 2016, the Korean Fair Trade Commission (KFTC) imposed a fine of 351.6 billion won (S$425 million) against construction companies after they had rigged tenders to build liquefied natural gas tanks. This development is closely followed in many jurisdictions and construction companies should be mindful of the competition and anti-trust prohibitions in the countries they operate including under Singapore’s Competition Act (Cap. 50B).
