The impact of the ongoing pandemic on levels of M&A activity and 2020’s pipeline, in particular the difficulties it has posed for parties trying to progress deals, has been the subject of much discussion. However, for deals which were signed earlier this year or in the final months of 2019, many parties are unfortunately having to wrestle with a different problem - the resolution of disputes triggered or brought to light by the abrupt change in market conditions: see for instance, Realogy Holdings Corp v SIRVA Worldwide, Inc.; Forescout Technologies, Inc v Ferrari Group Holdings Inc..

Our speakers, Low Chai Chong (Senior Partner, Dentons Rodyk), Sakamoto Tetsuya (Lawyer, Shimada Hamba Osajima), together with forensic accountants Iain Potter (Partner, MDD) and Chen Xiao Fan (Accountant, MDD), will look at the issues arising in M&A disputes this year, in the midst of COVID-19. The panel discussion will be moderated by Ng Sook Zhen, Partner and Head of Japan Desk at Dentons Rodyk. The speakers have between them more than 50 years of experience in disputes and dispute-related accountancy and hope to share their experiences on the issues to be considered in conducting M&A Disputes in the COVID-19 era.
