Edric Pan is the Joint Deputy Managing Partner of Dentons Rodyk, and is a Senior Partner in Dentons Rodyk’s Litigation and Dispute Resolution and Arbitration practice groups. He heads the firm’s Aviation practice, and co-heads its Employment and Insurance practices.

Edric is a highly experienced litigator, having handled a wide range of civil and commercial disputes work, including international commercial disputes, actions relating to breaches of directors' and fiduciary duties, multi-million dollar insurance claims, employment disputes, professional negligence, aviation claims, construction related disputes, and professional disciplinary proceedings. In over 25 years of litigation practice, Edric has been involved in many high profile matters and has successfully acted for clients up to the Court of Appeal, Singapore’s highest court.

In the Insurance space, Edric specialises in claims defence work. He is especially recognised for his work in the professional negligence field, and is frequently instructed to act for lawyers, accountants, financial advisors, engineers, and other professionals in professional negligence claims. He also handles a wide range of other matters relating to all manner of insured losses spanning D&O, business interruption, property damage, personal injuries, aviation disaster claims and others. He served for many years as the Vice-Chair of the Law Society’s Professional Indemnity committee. Edric also regularly advises and acts for insurers on policy coverage issues.

On the Employment front, Edric regularly advises and represents parties in non-compete and wrongful termination disputes, among others. 

Edric has delivered workshops and seminars on employment law and insurance law, among others. He also co-authored a chapter in the Employment Law volume of Halsbury's Laws of Singapore. 

Outside of practice, Edric sits on the Committee for Private Education.

Experience

  • Lufthansa Technik: Advising on contractual drafting and negotiations with the government of a Southeast Asian nation in relation to the outfitting of a new airliner for use by the country’s head of state and his family.
  • A Singapore company and its CEO: Acting in defence of an US$230 million claim for alleged fraudulent misrepresentations and conspiracy in relation to certain investments made by the plaintiff into the client’s parent company (a major Thai listed company). The matter also involved proceedings in numerous other jurisdictions – the British Virgin Islands, Thailand, Cyprus and Cambodia.
  • A firm of consultant engineers:Acting for the clients in relation to a S$18 million High Court claim brought by the Singapore government arising from a failed construction project.
  • Confidential Client: Acting for the client in arbitration proceedings to resist a US$5 million claim by an aircraft management company for alleged wrongful termination, and to prosecute a counterclaim against the aircraft management company in fraud and breach of contract.
  • A multinational heating, ventilation and air-conditioning (HVAC) manufacturer: Acting in arbitration proceedings in Shanghai under the CIETAC Rules against a Chinese state-owned entity, for breach of contract in respect of a major order of HVAC equipment for offshore rigs.
  • Energy Market Company (EMC): Acting for the operator of Singapore’s wholesale electricity market, in respect of a claim brought by EMC’s former general counsel for alleged misrepresentation and breaches of her employment contract. The matter was contested up to the Court of Appeal, where a decisive ruling in EMC’s favour was obtained.
  • A leading global concierge services provider: Acting in High Court proceedings against a market competitor as well as a former high-level employee of the client in respect of breaches of non-compete and non-solicit covenants, unlawful copying and misuse of confidential information, inducement of breach of contract, and conspiracy to injure.
  • A major international insurance broker: Acting in High Court proceedings against two former high-level employees and directors of the client’s Trade Credit team, who had left to join a competitor and who had poached other members of their team, as well as a large number of clients. The claims were founded in conspiracy, breaches of non-compete obligations, breaches of duties of fiduciary duties and duties of trust and confidence, and breaches of confidentiality.
  • A global advertising agency: Acting in defence of a claim brought by a market competitor for alleged inducement of breaches of contract arising from the employment by the client of a former employee of the market competitor.
  • A building systems and solutions company: Acting in High Court proceedings against the client’s former Managing Director for damages arising from breaches of director’s and fiduciary duties, breaches of duties under the Companies Act, and for recovery of unauthorised salary and benefits which he had received over the course of several years.
  • Singapore Tourism Board (STB): Acting against a well-known UK-based concert organiser in respect of the failure by the latter to organise what was to have been Singapore's largest-ever entertainment and musical event. Among other things the STB sought damages for breach of contract and an account of several million dollars in funds which had been paid to the concert organiser towards the event but which had been misused. Issues involved included breach of contract, trust, misrepresentation and lifting of the corporate veil. After a full trial in the High Court, judgment was returned in favour of the STB, and this was upheld by the Court of Appeal.
  • Several international fund management companies: Acting in a lawsuit against an Indonesian company and its shareholders, seeking payment of the sum of about US$30 million. Issues involved include forum non conveniens, force majeure, collateral undertakings and validity of service of process.
  • A Singapore telco and cable television company: Acting in an action brought by a rival telco arising from the alleged "tapping" of signals from leased optical fibre cables. Issues arising in this matter included determining the basis of assessment of damages where the losses suffered were punitive in nature and hence not directly quantifiable.
  • A subsidiary of an Indonesian group of companies: Acting in a massive cross-border claim for over US$200 million by several US-based funds, arising from one of the largest bond defaults in history. This matter involved complex issues of conflict of law, res judicata and fraud.
  • A major IT solutions provider: Acting in a claim against a local university for breach of contract, arising from the failure of a multi million dollar project to create and implement a campus-wide IT and data management system.
  • Law Society: Acting for the Law Society on several occasions in Disciplinary Committee proceedings against solicitors, in respect of breaches of professional duty under the Legal Profession Act.
