Hui Min is a senior partner in Dentons Rodyk's Litigation and Dispute Resolution and Arbitration practices, and the Co-Head of the Real Estate Disputes practice. She is effectively bilingual in English and Chinese, and her main areas of practice encompass commercial litigation and arbitration, insolvency cases, landlord and tenant disputes, real-estate and property-related disputes, and employment disputes. She represents and advises companies and individuals on a wide array of commercial issues including commodities disputes, international sale of goods, directors' duties, and shareholders' disputes, and has particular experience acting for companies in international arbitrations with respect to claims for breach of warranty in commodities disputes.

In her real estate practice, Hui Min has acted for developers in property-related disputes, including matters under the Building Maintenance and Strata Management Act against management corporations (MCSTs), and regularly advises and acts for developers and owners in respect of defects and tenancy disputes.

Hui Min has also acted for a variety of clients in employment matters, and possesses particular expertise in the area of confidentiality and restrictive covenants. She also regularly advises clients on the tort of defamation and issues under the Personal Data Protection Act, arising out of publications.

Experience

  • Wingcrown Investment Pte Ltd v Mannepalli Gayatri Ram: Successfully acting for a developer against a purchaser of a residential property who was in early possession, with an extended completion date. The purchaser failed to complete the sale and purchase, and also refused to return possession of the property back to the developer. We successfully recovered possession of the property for the developer and thereafter successfully obtained damages in the sum of over S$720,000 (including legal costs on a full indemnity basis). In a landmark decision, the High Court found that the developer was entitled to damages for the purchaser holding over the property calculated on a double rent basis on the grounds that the purchaser was a trespasser from the time the sale and purchase agreement was terminated to the time the purchaser delivered possession of the premises back to the developer. The High Court decision was reported as Wingcrown Investment Pte Ltd v Mannepalli Gayatri Ram [2023] SGHC 1.
  • Tongbao (Singapore) Shipping Pte Ltd: Successfully acting for a company against its joint venture partner and its former director for breach of fiduciary duties in connection with the construction of a vessel for which the joint venture was entered into. Reported at Tongbao (Singapore) Shipping Pte Ltd and another v. Woon Swee Huat and others [2018] SGHC 165.
  • Confidential client: Acting for a Chinese company in defending a claim by a Singapore company in an SIAC arbitration for breach of a contract for sale of coal.
  • Confidential client: Successfully acting for a Chinese company in an SIAC arbitration against a Singapore company for breach of warranty in a contract for sale of coal where issues relating to the sampling and quality of coal and the finality of certificates of quality issued were discussed.
  • Ritzland Investment Pte Ltd: Successfully acting for a landlord in its claim for rent against a tenant, where issues of whether the landlord had capacity to lease premises beyond the tenure of its master lease were discussed. Reported at Ritzland Investment Pte Ltd v Grace Management & Consultancy Services Pte Ltd [2014] 2 SLR 1342. This case is the leading authority on the issue of tenancy by estoppel.
  • Confidential client: Successfully acting for a Chinese company in an SIAC arbitration against a Singapore company for breach of contract for sale of iron ore lumps.
  • Confidential client: Acting for a Singapore company in an ICC arbitration against another Singapore company for breach of a contract for sale of iron sand.
  • Confidential client: Acting for a Chinese company in an HKIAC arbitration against a Singapore company for breach of warranty in a contract for sale of coal, where issues relating to the sampling and quality of coal and the finality of certificates of quality issued were discussed.
  • Confidential client: Successfully acting for a Chinese state-owned entity in a SIAC arbitration against an Indonesian company for breach of a contract relating to the sale of coal.
